Lately The Code of Administrative Offences of the Russian Federation was essentially updated and began to borrow conducting position in regulation of public relations. As a subject of regulation of administrative law is set of those relations which develop in sphere of the government, considering the citizen as the subject of administrative law, in the present situation observance of the constitutional principle of independence of the rights and freedom of the person from an arbitrariness of the state is especially important. The possession the rights and freedom on which the state cannot encroach, does the person, the citizen, the independent subject, capable to be ratified as a worthy member of a society. At the same time relations of the person and the state are not exhausted by a duty of the state to not encroach on human rights.
The citizen is involved in steady legal communication with the state, consisting of the mutual rights and duties. The persons constantly living in territory of the concrete state, are vitally interested in possession in the status of the citizen. And the state ratified on the basis of the right and democracy, can provide most effectively is right also freedom of citizens.
The Russian state, having fixed human rights and the citizen in the Constitution, undertakes through activity of bodies of the government, management, court, Office of Public Prosecutor, protection of the law and order to carry out their realization and protection.
However, not all rights and duties of the person and the citizen depend on its constitutional legal status (The Code of Administrative Offences of the Russian Federation.
). A lot of such which are outside such status and are established by the statutory acts corresponding to the constitutional concept of position of the person and the citizen in the Russian Federation. For example, rights and the duties connected to management by vehicles, purchase of the weapon and etc.
